This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.
We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
Interpretation and Definitions
Interpretation
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Service or parts of our Service.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Application refers to Dwellable, the software program provided by the Company.
- Business, for the purpose of CCPA/CPRA, refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.
- CCPA and/or CPRA refers to the California Consumer Privacy Act (the "CCPA") as amended by the California Privacy Rights Act of 2020 (the "CPRA").
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Dwellable LLC.
- Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
- Country refers to: United States
- Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
- Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
- Personal Data is any information that relates to an identified or identifiable individual. For the purposes of the CCPA/CPRA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
- Service refers to the Application.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Address, State, Province, ZIP/Postal code, City
- Usage Data
Account Information (Sign in with Apple)
When You create an account using Sign in with Apple, We receive from Apple the information You choose to share, which may include Your name and email address. Apple may also provide a private relay email. Your use of Sign in with Apple is also subject to Apple's Privacy Policy.
Payment and Subscription Information
When You make in-app purchases or subscriptions, payment processing is handled by the Application Store (Apple or Google). We use RevenueCat, a service provider, to manage subscriptions and verify purchase status. RevenueCat may receive and process purchase-related identifiers. We do not store Your payment card details; those are managed by the Application Store.
AI Assistant
When You use the AI assistant feature, We collect and process the messages You send, related information about Your property, and the assistant's responses in order to provide and improve the service. To generate responses, We share Your inputs and related context with third-party artificial intelligence service providers that process this data on Our behalf as Service Providers, including Groq, OpenAI, and Perplexity. These providers process the data to return a response and in accordance with their respective terms; We do not use Your assistant conversations to train independent or third-party AI models. AI assistant data may be stored and used to operate, secure, and improve the assistant and Our Service. Please do not share sensitive personal information (such as passwords, government identifiers, or financial account details), or other people's personal information, in assistant conversations.
Analytics
We use analytics services (such as Amplitude) to understand how Our Service is used. This may include information about Your interactions with the Application, device type, and usage patterns. This helps Us improve the Service.
Cookies and Tracking Technologies
Our website and Service use cookies, software development kits (SDKs), pixels, device identifiers, and similar tracking technologies to operate the Service, remember Your preferences, measure performance, and support analytics and advertising. Cookies may be "persistent" or "session" cookies. You can instruct Your browser to refuse cookies or to indicate when a cookie is being sent; however, if You do not accept cookies, You may not be able to use some parts of Our website. You can also manage advertising identifiers through Your Device settings.
Advertising and Marketing
We use third-party advertising and measurement services to promote Our Service and understand the effectiveness of Our marketing. These include the Meta (Facebook) Pixel and Conversions API and Google Ads conversion tracking. To measure and improve Our advertising, We may share certain information—such as online identifiers (for example, cookie identifiers and click identifiers), device information, IP address, and event information (for example, that You visited Our site or installed or interacted with the Application)—with these providers, who may use it to deliver and measure ads, including across other websites and apps. Depending on Your jurisdiction, this activity may be considered "sharing" or a "sale" of personal information under applicable law. Please see "Your Privacy Rights" and "Your California Privacy Rights" below for how to opt out.
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device's unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device.
Information Collected while Using the Application
While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:
- Pictures and other information from your Device's camera and photo library
We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.
You can enable or disable access to this information at any time, through Your Device settings.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service, including to monitor the usage of our Service.
- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
- To contact You: To contact You by email or push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including security updates, when necessary or reasonable for their implementation. You can opt out of marketing emails at any time using the unsubscribe link, and You can disable push notifications in Your Device settings.
- To provide You with news, special offers, and general information about other goods, services and events which We offer that are similar to those that you have already purchased or inquired about unless You have opted not to receive such information.
- To manage Your requests: To attend and manage Your requests to Us.
- For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
We may share Your personal information in the following situations:
- With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to provide AI assistant functionality, to process subscriptions, and to contact You.
- With advertising and analytics partners: We may share online identifiers, device information, and event data with advertising and analytics partners (such as Meta and Google) to measure and improve Our marketing, as described in "Advertising and Marketing" above.
- For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
- With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
- With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
- With Your consent: We may disclose Your personal information for any other purpose with Your consent.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer periods.

The security of Your Personal Data is important to Us. We use commercially reasonable administrative, technical, and organizational measures designed to protect Your Personal Data. Depending on where You live, You may have rights regarding Your Personal Data, including the right to access, correct, update, or delete Your Personal Data, and the right to opt out of marketing communications. You can exercise many of these choices directly:
- Access and update: You can review and update certain account information within the Application.
- Marketing emails: You can unsubscribe using the link in any marketing email.
- Push notifications and device permissions: You can disable push notifications, camera, photo, and location access through Your Device settings.
- Advertising: You can limit ad tracking through Your Device settings and manage cookies through Your browser, as described above.

We may need to verify Your identity before fulfilling certain requests, and We may decline requests where permitted by law.
Deleting Your Account and Data
You may request deletion of Your account and associated Personal Data at any time through the Application's account settings, or by emailing Us at [email protected]. Upon a verified request, We will delete or de-identify Your Personal Data, except where We are permitted or required to retain it (for example, to comply with legal obligations, resolve disputes, prevent fraud, or enforce Our agreements).
Your California Privacy Rights (CCPA/CPRA)
This section applies to You if You are a California resident, and supplements the information above. Under the CCPA/CPRA, You have the following rights:
- Right to know / access: to request the categories and specific pieces of Personal Data We have collected about You, the sources, the purposes for collecting it, and the categories of third parties with whom We disclose it.
- Right to delete: to request deletion of Personal Data We have collected from You, subject to certain exceptions.
- Right to correct: to request correction of inaccurate Personal Data.
- Right to opt out of sale or sharing: to opt out of the "sale" or "sharing" (for cross-context behavioral advertising) of Your Personal Data.
- Right to limit use of sensitive personal information: to the extent We use sensitive personal information beyond permitted purposes.
- Right to non-discrimination: We will not discriminate against You for exercising any of these rights.
Categories of Personal Data collected. In the past twelve months, We may have collected the following categories of Personal Data: identifiers (such as name, email address, and device identifiers); customer records (such as mailing/property address); commercial information (such as subscription and purchase history); internet or other network activity (such as usage and interaction data); geolocation data (approximate, based on address or device, where permitted); audio/visual information (such as photos You upload); and inferences drawn from the above. We collect this data from You, from Your Device, and from Our Service Providers and partners.
Sale or sharing of Personal Data. We do not sell Personal Data for money. However, Our use of advertising and analytics technologies (such as the Meta Pixel/Conversions API and Google Ads, described in "Advertising and Marketing") may be considered a "sale" or "sharing" of identifiers and internet activity information under the CCPA/CPRA. We do not knowingly sell or share the Personal Data of consumers under 16 years of age.
How to opt out of sale/sharing ("Do Not Sell or Share My Personal Information"). You may opt out by emailing Us at [email protected] with the subject line "Do Not Sell or Share," and by limiting ad tracking in Your Device settings and disabling advertising cookies in Your browser. Where supported, We honor opt-out preference signals (such as Global Privacy Control).
How to exercise Your rights. You may submit a request by emailing [email protected]. We will verify Your request as required by law. You may use an authorized agent to submit a request on Your behalf, subject to verification. We will not discriminate against You for exercising Your rights.
Children's Privacy
Our Service is not directed to individuals under the age of 18, and We do not knowingly collect Personal Data from anyone under 18. If You are a parent or guardian and believe Your child has provided Us with Personal Data, please contact Us at [email protected] and We will take steps to delete such information.
"Do Not Track"
Our Service does not currently respond to "Do Not Track" (DNT) browser signals, as no common industry standard for DNT has been adopted. Where required by law, We honor recognized opt-out preference signals such as Global Privacy Control.
Links to Third-Party Sites and Services
Our Service may contain links to, or reference, third-party websites and services (including local business listings and contractors) that We do not control. This Privacy Policy does not apply to those third parties, and We are not responsible for their privacy practices. We encourage You to review the privacy policies of any third party You interact with.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify You of any material changes by posting the new Privacy Policy on this page and updating the "Last updated" date, and, where appropriate, by other means. You are advised to review this Privacy Policy periodically. Your continued use of the Service after changes become effective constitutes acceptance of the revised Privacy Policy.
